Vicarious Liability – Rental Car Company - Federal Transportation Equity Act
The Peterson Bernard team prevailed on a Motion to Dismiss, in part, on behalf of a rental car company pursuant to the Federal Transportation Equity Act. Plaintiffs sued the rental car company under a theory of vicarious liability for significant injuries sustained in a motor vehicle accident. The Court granted Defendant’s Motion to Dismiss, limiting Plaintiffs’ claimed damages to $10,000/$20,000 pursuant to Fla. Stat. 324.021(7).
