First Party Practice
Peterson Bernard takes pride in representing insurance carriers in the defense of first party claims and coverage disputes. Over the years, the firm has handled a variety of legal matters. Our attorneys are prepared to assist in the development of objective factual information relating to the claim, document requests, and examinations under oath designed to resolve problematic claims before litigation. As part of this representation, we provide analysis of coverage issues and the carrier’s statutory and contractual obligations as well as case law that may affect the outcome of such claims.
Where litigation does ensue, we have successfully defended carriers’ rights under the policy and Florida law. Our attorneys are called upon to assess bad faith exposure in advance of the formal prosecution of the claim and to represent insurance carriers at all stages of litigation, including mediation, or other alternative dispute proceedings and trial. Our attorneys have represented carriers in the investigation of catastrophic claims during the initial claims proceeding and in supplemental litigation.
